The Ansell group of companies (referred to as: “Ansell”, “we”, “us”, “our”) respects your privacy and we are committed to protecting it through our compliance with this Privacy Policy. This Privacy Policy governs the processing of your personal data by Ansell captured through the following methods:

  • when you visit our global and local websites (the “Website”); and/or
  • when you communicate with us via e-mail, text, telephone, fax, social media channels, and/or other electronic messages through this Website or our products or services; and/or
  • when you make use of our products or services (e.g. mobile/desktop applications or Ansell Inteliforz™); and/or

1. IN GENERAL

1.2. A reference in this Privacy Policy to certain laws or regulations also includes any change, replacement or annulment of these laws or regulations, including any related executive decisions.

1.3. Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is to not use our Website or our products or services. By accessing or using this Website, our products or services, you agree to this Privacy Policy. Ansell reserves the right to from time to time modify, change or amend this Privacy Policy at its own discretion. 2. TYPES OF PERSONAL DATA WE COLLECT

2.1. When you use our Website, our mobile or desktop applications, or use our social media channels, contact form or any other digital communication channel, we collect and use the following personal data.

  • Technical information (e.g.,server log files) about your visit and the device you use (e.g., IP address, browser type, geographical location and operating system). In general, we cannot identify you on the basis of this information, but third parties may be able to identify you (e.g. you internet service provider). We process this information in order to ensure the most fault-free operation of our Website and to detect and prevent malware, illegal content and conduct and other forms of potential abuse. We rely on our legitimate interest in keeping our online presence safe.
  • If you have an account with us, identity and contact information to create and manage your account. We rely on an agreement that we have with you through your acceptance of the applicable terms and conditions.
  • Upon your consent, we process information about your browsing behavior, how you use our Website and the device that you use.   • Identity and contact details provided by you (e.g., the company you work for) and the content of the message and the technical details of the message itself. We rely on our legitimate interest in being able to respond to requests, questions or comments or to contact you proactively for questions of any kind.
  • Upon your consent, we process your email address and other personal data to personalize our communication with you (e.g., name and language). We process this information in order to send you electronic communication. We rely on your consent, unless you are an existing customer whom we wish to keep informed of our products or services.

2.2. When you use our products or services (e.g., Ansell Inteliforz™) or when you provide feedback with regard to our products or services (e.g., via a survey), we collect and use the following personal data:

  • Identity details, contact details, technical information about your device and information about your use of our products or services. We process this information in order to create and manage your account. We rely on the performance of the contract we have with you.
  • In case we use the above-mentioned personal data to improve our products or services, we rely on our legitimate interest to improve existing products or services or to develop new products or services.
  • In case you provide feedback, your opinion about our products or services in order to improve our products or services or to contact you with regard to your feedback. We rely on our legitimate interest to analyze and improve our products or services. If you have bought products from us, we may rely on an agreement that we have with you (or your employer).

2.3. When you enter into an agreement with us or when you buy products from our webshop, we collect and use the following personal data:

  • Identity and contact details provided by you in the context of the agreement (e.g., professional function, or the delivery address in case you bought products from our webshop). We process this information in order to fulfil our contractual obligations, and if you are a customer, to deliver our products or provide our services, including processing, performing or delivering orders or processing payments and communicating with you in this context. If you are our customer or supplier as an individual, we rely on the necessity of processing your personal data for the performance of the contract we have with you. However, when you act on behalf of a company or other legal entity, we rely on our legitimate interest in being able to contract with customers and suppliers.
  • Financial account information if you make purchases with us, including your billing address, delivery address, credit/debit card number, expiration date, security code, or other billing/payment information. We process this information to process and follow-up your order. We rely on an agreement that we have with you (or your employer).
  • Identity and contact details provided by you within the framework of the agreement and, if applicable, your company and invoicing details. We process this information in order to carry out our normal business administration (e.g., invoicing and relationship management). We rely on our legitimate interest in managing our business activities in a responsible and professional manner.
  • Identity and contact details provided by you and the reason for your contact with our customer service (e.g., your problem with or feedback about our products or services). We process this information in order to solve your problems or your process feedback and communicate in you this regard. We rely on our legitimate interest in striving for high customer satisfaction.
  • Your email address and information about your previous purchases if you are an existing customer and you did not object to this. We process this information in order to send you our electronic communication. We rely on our legitimate interest to inform you as an existing customer about our products and services and to improve our customer relationship.

2.4. When you register for or participate in our events (e.g., sweepstakes or contests), we collect and use the following personal data:

  • Identity and contact details provided to you us in connection with, where applicable, your registration and participation in our events (e.g., name, e-mail address, telephone number, postal address, company you work for or professional position). We process this information in order to handle your registration and prepare, organize and secure our events. We rely on our agreement with you by your acceptance of the applicable terms and conditions.
  • Your feedback about the event in which you participated and your identity and contact details provided to us in that regard, unless your feedback was anonymous. We process this information in order to evaluate the event and improve future events. We rely on our legitimate interest to be able to organize interesting events or to promote our products or services.
  • Upon your consent, photos taken during an event on which you are clearly recognizable. We process this information in order to capture and share ambience images of the event (e.g., on our website).

2.5. When you communicate with us via telephone, email or any other digital communication channel, we collect and use the following personal data:

  • Identity and contact details provided by you to us, the content of the communication, the technical details of the communication itself (e.g., date and time) and, if applicable, the device you used. We process this information in order to enable communication between you and us (e.g., when you use our contact form or contact us via telephone or email). We rely on our legitimate interest in being able to respond to requests, questions or comments or to contact you proactively for questions of any kind.

2.6. When you apply for a job, please refer to our privacy notice for applicants in Schedule 1.

2.7. For all personal data that we collect in the above circumstances, we would like to make it clear that we will also process the above-mentioned personal data for the following purposes:

  • To comply with our legal obligations or to comply with any reasonable request from competent police authorities, judicial authorities, government institutions or bodies, including competent data protection authorities. This is a legal obligation for us.
  • To prevent, detect and combat fraud or other illegal or unauthorized activities. This is a legal obligation for us.
  • To defend ourselves in legal proceedings. We rely on our legitimate interest in using your personal data in these proceedings.
  • To inform a third party in the context of a possible merger with, acquisition of/by or demerger by that third party, even if that third party is located outside the European Union (“EU”). We rely on our legitimate interest in entering into business transactions.

2.8. We receive all the personal data listed above directly from you. In certain specific cases, we may also receive personal data from your employer (in particular when you make use of our products or services like Ansell Inteliforz™). We may also receive additional information about your preferences and surfing behavior from our partners, including our business and commercial partners– who collect your personal data from you when you interact with them. When dealing with such third parties, these third parties will process your personal data in accordance with their own privacy policy.

2.9. Our Website is not intended for children under 16 years of age. No one under age 16 may provide any personal data to or on our Website. We do not knowingly collect personal information from children under 16. If you are under 16, do not use or provide any information on this Website, make any purchases through the Website, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information.

3. PURPOSES FOR WHICH ANSELL USES YOUR PERSONAL DATA

3.1. Ansell processes your personal data to provide you in a personalized and efficient way the information, products and services you request via the Website, by e-mail, telephone, fax or social media channels. If you use our products and services, we may use your personal data as part of our research and development activities to improve our products and services. If you stop using our products and services, we may anonymize your personal data. Ansell may process your personal data as part of products or services on behalf of our customer. In such cases, our customer will determine the purpose of processing your personal data and we refer you to the information provided to you by our customer.

3.2. Ansell processes your personal data for marketing purposes, i.e. to provide you with targeted communications, promotions, offerings and other advertisements of Ansell and selected partners.

3.3. Unless you are an existing customer who has already purchased similar goods or services from us and who we wish to target with our own marketing material, Ansell will only send you communications, promotions, offerings, newsletters and other advertisements via e-mail or other person-to-person electronic communication channels that you have explicitly consented to receive.

3.4. Ansell processes your personal data to comply with legal obligations or to comply with any reasonable request from competent law enforcement agents or representatives, judicial authorities, governmental agencies or bodies, including competent data protection authorities. Ansell may transfer your personal data to the police or the judicial authorities as evidence or if there are justified suspicions of an unlawful act or crime committed by you through your registration with or use of the Website, our social media channels or other communication with us.

3.5. Ansell processes your personal data to perform statistical analyses so that we may improve our Website, advertisement, products and services or to develop new products and services.

3.6. In addition to the purposes mentioned in this Article 3, Ansell processes your personal data to fulfill the purpose for which you provide it, or for any other purpose disclosed by us when you provide the information.

3.7. Ansell may process your personal data to preserve the legitimate interests of Ansell, its partners or a third party if your registration with or use of the Website, products or services, social media channels or other communication channels can be considered:

(a) a violation of this Privacy Policy, our Cookie Policy, Terms of Use, Terms of Sale, or any other agreements between you and Ansell;
(b) a violation of any applicable terms of use or our or a third party’s intellectual property rights or any other right;
(c) a threat to the security or integrity of the Website, products or services, social media channels or other communication channels;
(d) a danger to the Website, products or services, social media channels or other communication channels or any of Ansell’s or its subcontractors’ underlying systems due to viruses, Trojan horses, spyware, malware or any other form of malicious code; or
(e) in any way hateful, obscene, discriminating, racist slanderous, spiteful, hurtful or in some other way inappropriate or illegal.

4. LEGAL BASIS FOR PROCESSING YOUR PERSONAL DATA

4.1. The processing of your personal data for the purpose outlined in Article 3.3. above is based on your consent.

4.2. If your personal data is processed for the purpose outlined in Article 3.1. and in order to take steps prior to entering into a contract with us, we may process your personal data as necessary for the performance of that contract, or in the process of entering into that contract. However, if you are acting on behalf of a company or other legal entity with whom we have contracted, we may process your personal data based on our legitimate interest pursuant to Article 4.4.

4.3. For the purpose mentioned in Article 3.4., the processing of your personal data is necessary for Ansell’s legal obligations.

4.4. For the purposes mentioned in the Articles 3.2, 3.5 and 3.7 above, the processing of your personal data is necessary for purposes of our legitimate interests, such as:

  • continuous improvements of the Ansell Website, social media channels, products and services to ensure that you have the best experience possible;
  • aggregating personal data in the context of our products and services to gain insights into your use of them and to share these insights at an aggregate level with our customers;
  • anonymizing your personal data collected in the context of your use of our products or services to use the anonymized data in the context of our research and development activities and improving our products and services;
  • contracting with our customers and suppliers when processing your personal data if you act on behalf of a company or other legal entity;
  • keeping our Website, social media channels, products and services safe from misuse and illegal activity or protecting other users; and
  • marketing and promotion of our products, services, brands and overall successful commercialization of our products and services.

4.5. The processing of your personal data for the purpose outlined in Article 3.6. above is based on the legal basis disclosed by us when you provide the information. In the absence of this, the processing of your information is based on our legitimate interest as provided in Article 4.4.

5. TO WHOM ANSELL SENDS YOUR DATA

5.1. Ansell relies on third party processors to provide you our Website, products or services and to process your personal data on our behalf for the purposes set out in Article 3 above. These third-party processors are only allowed to process your personal data on behalf of Ansell upon explicit written instruction from us solely for the purposes for which we disclose it to them, and are contractually obligated to keep your personal data confidential. If these third parties process your personal data for their own purposes and they determine the means of doing so, we refer you to the information that these third parties will provide to you directly. You can also access this information in most cases by using our products or services.
Ansell warrants that all third-party processors are selected with due care and are obliged to observe the safety and integrity of your personal data.

5.2. Ansell may share your personal data with other entities within the Ansell group for the purposes of sales, marketing and financial data analysis. We will ensure that all Ansell entities will take due care that all processing of your personal data is in line with this Privacy Policy.
In the context of certain products and services, it is necessary to share (aggregated) personal data with our customers in order to perform the contract with our customer.5.3. Ansell may publicly disclose your personal data in cases of law, legal proceedings, litigation or mandatory requirements of the competent government authorities, including data protection authorities.

5.4. Ansell does not send your personal data in an identifiable manner to any third party other than those mentioned in Articles 5.1., 5.2 and 5.3, without your permission to do so. Ansell may send anonymized data to other organizations that may use such data for improving products and services as well as for the purposes of tailoring the marketing, displaying and selling of those goods and services.

5.5. When it comes to mergers, acquisitions or bankruptcy liquidation, Ansell will require new companies and organizations that hold your personal data to continue to be bound by this Privacy Policy, otherwise we will ask the companies and organizations to re-seek consent from you.

6. LOCATION, TRANSFER AND STORAGE

6.1. Ansell may need to transfer your personal data to other Ansell entities or third parties who process personal data on our behalf to locations outside the jurisdiction in which you provided it.
If you are based within the European Economic Area (“EEA”), please note that where necessary to provide the products and services, we may transfer personal data to Ansell entities located in countries outside of the EEA. Ansell will take the necessary steps to ensure that the transfer of your personal data complies with the applicable requirements. 6.2. Ansell may transfer anonymized and/or aggregated data to organizations outside the jurisdiction in which you provide it. Should such transfer take place, Ansell will ensure that there are safeguards in place to ensure the safety and integrity of your data and all rights with respect to your personal data you might enjoy under applicable mandatory law.

6.3. Ansell holds your personal data both electronically and/or in hard copy form. We may store your information on our own premises or the premises of our third-party processors or other service providers. We will protect personal data we keep in accordance with Article 7.4 below.

7. QUALITY ASSURANCES

7.1. Ansell does its utmost best to process only those personal data which are necessary to achieve the purposes listed under Article 3 above.

7.2. Your personal data is only processed for as long as needed to achieve the purposes listed under Article 3 above or up until such time where you withdraw your consent. In the context of our products and services, we will retain your non-anonymized personal data for as long as necessary, which means that the retention period will be no more than the period necessary to provide you or our customer with the products or services. However, if you do not use our products or services for a period of two years, we will consider you an inactive user and delete or anonymize your personal data. In the context of a legal dispute, we may retain your personal data for a longer period until such time as all possible legal remedies have been exhausted. In some cases, we may retain your personal data for a shorter period.
Withdrawing your consent may mean that you can no longer use all or part of our Website, products or services. Ansell will de-identify your personal data when it is no longer necessary for the purposes outlined in Article 3 above, unless there is:

  • an overriding interest of Ansell, or any other third party, in keeping the personal data identifiable; and/or
  • a legal or regulatory obligation or a judicial or administrative order that prevents Ansell from de-identifying them.

7.3. You understand that an essential aspect of our marketing efforts is about making our marketing materials more relevant to you. Ansell does this by:

  • customising your unique profile based on relevant characteristics as outlined in Article 2 of this Privacy Policy; and
  • using this profile to provide you with communications, promotions, offerings, newsletters and other advertisements about products and services that may interest you.

7.4. Ansell will take appropriate technical and organizational measures to keep your personal data safe from unauthorized access or theft as well as accidental loss tampering or destruction. All information you provide to us is stored on our secure servers behind firewalls. Any payment transactions will be encrypted using SSL technology. Access by Ansell personnel or its third-party processors will only be on a need-to-know basis and be subject to strict confidentiality obligations. Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal data, we cannot guarantee the security of your personal data transmitted to our Website. Any transmission of personal data is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.

7.5. If you are registered to receive communications, promotions, offerings, newsletters and other advertisements via e-mail or other person-to-person electronic communication channels, you can change your preferences for receiving such communications, promotions, offerings, newsletter and other advertisements by following the opt-out link provided in such communications.

8. YOUR RIGHTS

8.1. You have the right to request access to all of your personal data processed by Ansell in our capacity as data controller. Each request must be as specific as possible and preferably specify: (a) which processing activity you wish to exercise your right to access and (b) which data categories you wish to gain access to. Ansell reserves the right to charge an administrative fee for multiple subsequent requests for access that are clearly submitted for causing nuisance or harm to Ansell.

8.2. You have the right to ask that any inaccuracies in your personal data held by Ansell in our capacity as data controller be corrected free of charge. If you submit a request for correction, your request needs to be accompanied by proof of the inaccuracy.

8.3. You have the right to withdraw your earlier consent for the processing of your personal data.

8.4. You have the right to request that your personal data is deleted if such data is no longer required for the purposes set out in Article 3 above or if you withdraw your consent for its processing. For some products and services, you can delete your account yourself by going to the privacy settings page.
However, please keep in mind that a request for deletion will be evaluated by Ansell against:

  • the overriding interests of Ansell or any other third party; and
  • legal or regulatory obligations or administrative or judicial orders which may contradict such deletion.

Instead of deletion, you can also ask that Ansell limit the processing of your personal data if (a) you contest the accuracy of the data, (b) the processing is illegitimate, or (c) the data is no longer needed for the purposes listed under Article 3 above.

8.5. You have the right to object the processing of personal data if you prove that there are serious and justified reasons that warrant such objection. However, if the intended processing qualifies as direct marketing, you have the right to object such processing free of charge and without justification.

8.6. You have the right to receive from us in a structured, commonly-used and machine-readable format all personal data you have provided to us.

8.7. Ansell does not sell personal data without informing you. In any case, if Ansell sells your personal data to third parties, you have the right, at any time, to direct us not to sell your personal data.

8.8. You have the right to be free from discrimination or retaliation for exercising any of your rights as described above.

9. HOW TO EXERCISE YOUR RIGHTS

In order to process your request as efficiently as possible, all requests submitted through any of these methods should be dated and clearly state which right you wish to exercise and the reasons for it, if required.
In case we have any doubts about your identity, we may ask you to provide us a digitally scanned copy of your valid identity card (if you do not have an identity card, then your identity can be proven by any other government issued document that clearly confirms your identity). If you contact us via phone, Ansell may ask you for your signed confirmation and proof of identity.
Ansell will promptly inform you when we receive your request. If the request is valid, Ansell shall honor it as soon as reasonably possible and at the latest thirty (30) days after having received the request.
If you have any complaint regarding the processing of your personal data by Ansell, you may contact us through any of the methods listed above. If you remain unsatisfied with our response, you may file a complaint with the relevant regulator or data protection authority in your country.

9.2. In order to comply with certain requirements of relevant laws and regulations, Ansell will not be able to respond to your request in circumstances:

a. that directly relate to national security and national defense security;
b. that directly relate to public safety, public health and major public interests;
c. that directly relate to criminal investigations, prosecutions, trials and execution of judgments.
d. where there is ample evidence that you have subjective malice or abuse of rights.
e. where, in response to your request, you will cause serious damage to the legitimate rights and interests of you or other individuals and organizations; or
f. that involve business secrets.
